This newsletter provides an update on the laws that have been passed 2 months before (i.e. newsletter in March is updated for January). The newsletter aims at highlighting the laws that have a big impact on the businesses in Thailand.

The list of promulgated laws contains Acts, Decrees, Announcements, Regulations or Rules that have been published on the Royal Thai Government Gazette Website (http://www.ratchakitcha.soc.go.th/RKJ/announce/search.jsp).


The important laws we chose to discuss may not always be passed in the previous month, especially when no laws were passed in that particular month or the laws passed have minimal impact on foreign businesses.

    Business operators (manufacturing, construction, transportation, warehouse, telecommunications, hotels, shopping malls, etc.) that have 50 or more employees and fall under the list at the end of this Ministerial Regulation are required to manage safety, occupational health, and the environment in the workplace in accordance with the standards set forth in this Ministerial Regulation, and are required to establish a safety management system as set forth in this Ministerial Regulation within 60 days from the date when the number of employees reaches 50.

    According to this Ministerial Regulation, such safety management system must have a policy, management structure, implementation plan, evaluation process, and development plan, etc. The operator is required to effectively operate the system by publicizing this policy and making it known to all employees and reviewing it at least once a year. However, if the company complies with international standards such as ISO and OSHA, it is considered to meet the criteria set forth in this Ministerial Regulation.

  • 安全管理システムの基準を定める2022年省令

    従業員50人以上を有し、本省令の巻末リストに該当する事業者（製造、建設、運送、倉庫、電気通信、ホテル、ショッピングモール等）は、本省令で定める基準に基づき労働場所での安全、労働衛生、及び環境の管理が求められ、従業員数が50人に達した日から60日以内に本省令で定める安全管理システムを構築することが義務付けられています。
    本省令によれば、当該安全管理システムは方針、管理体制、実施計画、評価プロセス、開発計画などを有している必要があり、事業者は、本方針を公表し全従業員に周知徹底したり、少なくとも年1回は見直しを行う等、効果的な運用が求められています。ただし、ISOやOSHAなどの国際規格に準拠している場合は、本省令で定める基準を満たしているとみなされます。
