重要法令ピックアップ

最低賃金に関する賃金委員会の告示（第14号）（以下「本告示」）

本告示は、労働者保護法（B.E.2541）に基づき賃金委員会により発行され、これによりタイの一日の最低賃金が引き上げられました。本告示により、従前のホテル事業における最低賃金に関する賃金委員会の告示及び最低賃金に関する賃金委員会の告示（第13号）（以下併せて「旧告示」）は廃止されました。本告示により改定された最低賃金は、2025年7月1日から適用されます。
旧告示では、最低賃金は、各地域に応じてTHB337 – 400で、THB400の最低賃金の適用はチャチュンサオ、チョンブリ、プーケット、ラヨーン及びスラタニのうちサムイ島のみに限定されていました。また、バンコク（パトゥムワン区及びワッタナー区のみ）、プーケット、サムイ島等の特定地域に所在し、4つ星以上のホテル事業で従業員50名以上を雇用しているホテル事業もTHB400の最低賃金の適用対象となっておりました。
本告示では、THB400の最低賃金が適用される上記の地域に変更はありませんが、ホテル事業の要件が改定されました。その結果、THB400の最低賃金が適用されるホテル事業の対象範囲が、以下のとおり拡大されました。

バンコク
ホテル法（E. 2547）に基づく以下のいずれかに該当するホテル事業（所在地を問いません）

(a) ホテルタイプ2

1)客室数50室以上のホテル又は2)宿泊施設及びレストラン又は飲食サービスや調理のための施設の双方の施設を有するホテル

(b)ホテルタイプ3

1) 宿泊施設、2)レストラン又は飲食サービスや調理のための施設及び3) 娯楽施設又は会議室を有するホテル

(c)ホテルタイプ4

1) 宿泊施設、2)レストラン又は飲食サービスや調理のための施設、3) 娯楽施設及び会議室を全てを有するホテル

娯楽施設法E. 2509に基づき商業目的で設立された娯楽事業（所在地を問いません）。例：マッサージパーラー又は食品・アルコールその他の飲料が販売若しくは提供される施設。

上記の点以外には、以下のとおり最低賃金に変更はありません。

なお、法定の労働時間未満に労働時間が短縮された場合（労働者の健康と安全を脅かす可能性のある業務については1日7時間未満、それ以外の業務について1日8時間未満）でも、使用者は、労働者に対し、最低賃金以上の賃金を支払わなければなりません。

<外国企業は何をすべきか>

タイで事業を行う企業は、各地域における最低賃金を確認した上で、これに応じた最低賃金以上の賃金を労働者に支払う必要があります。特に、対象となるホテル事業及び娯楽業は、所在地に関わらず1日当たりTHB400バーツの最低賃金が適用されることに留意する必要があります。また、最低賃金の改定により人件費が増加するため、企業の財務状況に影響がある可能性があります。最低賃金の支払い関して違反した場合には、労働保護法第144条に基づき、最高6ヶ月の禁固刑、最高THB10万の罰金、又はそれらが併科される可能性があります。

Important Laws Pick Up

The Notification of the Wage Commission regarding the Rates of Minimum Wage (No.14)

This Notification was issued by the Wage Commission under the Labour Protection Act, B.E. 2541, and it increases the daily minimum wage in Thailand. The Notification of the Wage Commission regarding the Rates of Minimum Wage for Hotel Businesses and the Notification of the Wage Commission regarding the Rates of Minimum Wage (No.13) (Collectively referred to as the “Previous Notifications”) were revoked by this Notification. The new minimum daily wage outlined herein has been enforced for all employers and employees in Thailand starting from 1st July B.E. 2568 (2025).
Under the Previous Notifications, the daily minimum wage ranged from THB 337 to THB 400 per day for every business. The daily minimum wage of THB 400 rate was limited only to the specific provinces of Chachoengsao, Chon Buri, Phuket, Rayong, and only Samui Island district in Surat Thani, as well as certain hotel businesses that are a 4-stars or higher, employ at least 50 employees, and are located in the specific areas (such as Bangkok, only Pathum Wan District and Watthana District, Phuket and Samui Island).
Under this Notification, the above specific provinces where the daily minimum wage of THB 400 rate is applicable remains unchanged, but the eligibility criteria for hotels have been revised. The scope of the THB 400 daily minimum wage has been expanded to include the following:

Bangkok;
Hotel businesses (regardless of location) under the Hotel Act, B.E. 2547 that fall into any of following categories (a)Hotel types 2: hotels with more than 50 rooms or hotels providing both accommodation and restaurants or places for food service or food preparation;
(b)Hotel types 3: hotels providing accommodation, restaurants or places for food service or food preparation, and entertainment venues or meeting rooms;
(c)Hotel types 4: hotels providing accommodation, restaurants or places for food service or food preparation, entertainment venues, and meeting rooms; and
Entertainment businesses (regardless of location) under the Entertainment Place Act, E. 2509 that are established for commercial purposes (such as massage parlors or premises where food, alcoholic beverages, or other drinks are sold or served).

Aside from these changes above, the minimum wage remains unchanged, as detailed below.

Companies and employers in Thailand are obligated to pay their employees at least the daily minimum wage, even if the employees’ working hours are reduced to less than the statutory working hours (7 hours per day for work that may pose health and safety risks, or 8 hours per day for other work, as specified in the Labour Protection Act, B.E. 2541).

<What should the companies do?>

Companies and employers operating businesses in Thailand, whether registered under Thai laws or not, must verify the provinces in which they conduct business and ensure they pay their employees at least the daily minimum wage specified in this Notification. Particularly, hotel and entertainment businesses subject to this Notification are required to apply the highest minimum wage rate of THB 400 per day, regardless of location. Additionally, these companies and employers should assess their financial situation, as the new wage requirements will lead to higher labor costs. Non-compliance may result in imprisonment for up to 6 months, a fine of up to THB 100,000, or both, under Section 144 of the Labour Protection Act, B.E. 2541.
